Mr. Bao's Accusation Against Ms. Han (LiXingXing)
Mr. Bao filed four complaints against Ms. Han for below five crimes from April to May 2020, which were officially agreed to be processed together with the criminal investigation against Mr. Bao and responded concurrently upon its conclusion as they both involved the same matter, but so far no official response has been received.
(1) Crime of False Charge:
Ms. Han deliberately and inconsistently misrepresented to various police officers, journalists, lawyers and social workers about her age and time of our first sex in order to falsely charge me for statutory rape. She also discussed with others whether I can be charged for statutory rape if she represented our first time earlier to the end of 2015. In fact, the time of our first sex was in October 2017 when we had engaged after meeting my parents, while a few months earlier she inadvertently told me that she would reach the marriage age of 20 after 2 years so asked me to wait for her. To get attention and sympathy, she fabricated miserable scenarios with fake evidence such as coerce, confinement, torture and brainwashing, all of which can be easily quashed with abundant evidence such as chat and travel history. To pretend a child, she lied to others that she was very short and thin weighed merely 35 kg when we met, but it is proved that she was about 1.7 meter tall and over 50 kg with very mature appearance (see the photo below taken at that time), and never showed her ID card despite of my repeated request.
More outrageously, Ms. Han even lied to the police that she was born in 2002 with attempt to falsify that she had sex with me under the age of consent of 14, albeit she actually was born in 1997 and had reached 18 prior to our first meet in October 2015. Later she changed the lie to being born in 2001, and also fabricated an adoption relationship with me, apparently with the same intent to falsely charge me for statutory rape for sex with minor between 14 and 18 under guardianship. As such, with the intent of falsely charging me for statutory rape, Ms. Han perjured herself on her age and the time of our first sex, and also viciously falsified the miserable scenarios to draw public attention, as a result I was put under criminal investigation with compulsory measures, therefore she has committed the crime of false charge. Moreover, Ms. Han filed dozens of complaints for rape or molestation all over China, few involving me, so it deserves further investigation whether those complaints constitute false charge and determine whether she should be prosecuted as recidivist.
(2) Crime of Fighting in Public:
Ms. Han, in conspiracy with her team, with the intent to draw public attention and influence justice by media, viciously fabricated a shocking story of “tortuous sexual assault of minor by adopt father,” and organized and calculated to spread online madly. They hysterically defamed and abused me and the case handlers, ignited public rage, incited emotional confrontation and mobbed the dissenters by all extreme means such as curse, humiliation, intimidation and human flesh search, in order to mislead the media and the public, which caused nationwide and unprecedented cyberbullying with worldwide attention. Consequently, not only I suffered devastating and irreparable economic and reputational loss, but also my companies, schools, classmates, colleagues, relatives and friends were all harassed, the agencies and officers in charge of the case came under fire, the government’s credibility was questioned by the public, the legal due process was inferenced, the internet and social environment was endangered, and the social stability and public order were disrupted. Furthermore, by filing fake complaints in multiple cities during the past few years, pushing or withdrawing intermittently, and telling discrepant stories, she wasted a huge amount of police resources. As such, Ms. Han has committed the crime of fighting in public, and/or the crime of fabricating and deliberately spreading fake information.
(3) Crime of Extortion:
In the end of 2015 merely 2 months after we got acquaintance, Ms. Han and her mother hoped me to marry her in the future, but I was not yet in love with her at that time. Though we lived far apart and seldom met each other, she actively expressed her love online, so I gradually fell in love with her and engaged in October 2017 after meeting my parents together, and gave her engagement ring at her request. However unbeknownst to me, Ms. Han simultaneously dated with other men, and broke her promise of marriage in March 2019. Outrageously, she required me not to marry anyone or have any child, so I can only spend the rest of my life with her without marriage or kid, which severely impaired my personal rights with an intent to get all my assets in the future.
Since I rejected her absurd requirement, Ms. Han started to threaten me by filing criminal charge, exposing our privacy, defaming me publicly, and pretending suicide or illness, in order to coerce me to accept her requirement or else get a huge compensation by false charge. Meanwhile she deceived or forced social workers, journalists, lawyers and police officers in similar way to achieve her nefarious goal. She used to ask for money under various pretexts, but after she received legal advice that she may be culpable for extortion if demanding money outright but may not if doing so in the process of criminal prosecution, she no longer mentioned any specific amount and instead said I can’t afford the compensation for “hurting her” and she can’t be dismissed with mere tens of thousand dollars. She on one hand sometimes loved me and some other times intimidated me, and on the other hand intermittently pushed or withdrew the case depending on how we got along, making me feel like she can dictate my destiny. Given her vile conduct and its grave consequence, Ms. Han has committed the crime of extortion.
(4) Crime of Defamation:
Ms. Han, in conspiracy with the news media South Reviews and its journalist He Yan and editor Li Shaowei, elaborately fabricated an explosive news article in the title of “Suspected Sexual Assault of His Minor Daughter, Reveal the Mask of This President Father” which is materially fake, fictitious or fraudulent from its title to content. It gained about 15 million reads, 500 thousand reposts, 120 thousand comments and 2.5 million likes, republished or quoted by numerous domestic and international media, and provoked an online storm nationwide and even worldwide. As a result, I suffered unprecedented cyberbullying, media trial and human flesh search, became an evil scolded and spat on by millions of people, had to resign from all posts and suspended doctoral study, received thousand abusive phone calls and text messages in a single day, lost all standing and reputation and incurred social death, and even my whole family suffered great physical and emotional distress. Given its extremely tortuous course and consequence, this defamation is one of the most notorious in the human history.
Although the crime of defamation usually is subject to private prosecution, there is an exception of severely threatening social order or national interests, in which case public prosecution should apply. Severely threatening social order occurs when the defamation arouses public anger locally, and severely threatening national interests occurs when the defamation causes negative impact internationally. This defamation has aroused public anger nationwide and caused negative impact worldwide, so it should fall within the exception and be subject to public prosecution.
(5) Crime of Swindle:
Ms. Han, together with her mother, first reached out to me asking for adoption in September 2015, tearfully described their miserable life, and then in the end of 2015 when we both realized I was unable to adopt her, she instead proposed to establish a family with me by marriage in the future. Although we lived far apart and seldom met, she actively contacted me online and by phone, expressing her love and asking for money from time to time. She told me she had been studying in school since October 2016, often mentioning her class, test and homework and asking me to pay her tuition. She seemed too busy to meet or contact me, but asked me to wait for her to live together and get married after her graduation in 2019, and didn’t allow me to be close with any other woman.
I sympathized her so kept in touch, talking about her study and living, and meeting her upon her request. Chased by her, I gradually fell in love and cherished her. We engaged after meeting my parents together in October 2017, and I also gave her engagement ring at her request. I loyally waited for her coming after graduation to get married. I have given her thousands of dollars for study, and in addition she asked for tens of thousand dollars for repayment of student loan and another tens of thousand dollars for marriage gift, which I agreed to give her upon marriage. However, she started to refuse marriage since March 2019, and I was told by police in April that she hadn't studied in school for years, at which time I realized I had been cheated for years. As such, with the intention to illegally possess, Ms. Han kept in touch with me under the pretext of adoption and marriage successively, lied about her study in school, and received substantial amount of money by fraud, thereby committed the crime of swindle.
